MAKE A LASTING POWER OF ATTORNEY
AND GUARD AGAINST THE FUTURE
Being able to manage our money and your affairs is a basic everyday action. But as we grow older our ability to do so decreases and the risk of a sudden event/illness robbing us of our faculties increases.
If for whatever reason you became unable to manage your money and affairs this could have a very serious effect on your welfare and cause a great deal of worry, cost and time for your loved ones. The problems would not just be for your loved ones as an inability to deal with your money could cause you personal nuisance and loss on investments as assets are effectively frozen.
In these circumstances your loved ones would have to apply to the Court of Protection for an order appointing themselves as your “Deputy”. This process is very expensive and very time consuming. Apart from the initial cost, which can be in the region of £1000, they would be required to file annual accounts and pay annual fees to the Court of Protection and could easily have an ongoing annual cost of over £1000 in managing things.
That’s the bad news!
The good news is that there is now a simple way of avoiding that problem.
It’s called a Lasting Power of Attorney
By making a Lasting Power of Attorney ( LPA ) whilst you are mentally and physically able to do so you can declare who you want to look after your money and affairs and make decisions about your welfare. You can choose your spouse, your children or any other trusted person
The important point to bear in mind is that when you make the LPA you do not in any way lose control of your affairs. The LPA simply gets stored away (just like your Will in fact).
It only gets put into effect when you choose to register it at the Court of Protection.
You can do that at any time in the future when it is right for you or it can be registered by your chosen attorney in the event of your suddenly or gradually losing your ability to look after you affairs. Of course the point is that by doing it now when you are competent you remove the chance of leaving it too late!
